Terms of Service

1) Who we are

The Service is provided by Pop The Plan ("Pop The Plan", "we", "us", "our").

2) Eligibility

You must be at least 18 years old (or the age of majority where you live) to use the Service.

3) Accounts and security

• You sign in using Google authentication.
• You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account.

4) The Service

Pop The Plan provides tools to help you plan an event (e.g., tasks/checklists, timelines, budgets, vendors, guests, seating charts, rentals, accommodations, and design inspiration tools).

We may modify, suspend, or discontinue parts of the Service at any time.

5) Your content and responsibilities

The Service lets you create and store content, including wedding planning information, notes, and uploaded images ("User Content").

• You own your User Content as between you and Pop The Plan.
• License to operate the Service: You grant Pop The Plan a limited, non-exclusive license to host, store, reproduce, display, and process your User Content solely to operate, maintain, and improve the Service.
• Third-party data: If you enter information about guests or other people, you represent you have the right to do so and that you will comply with applicable law.
• Uploaded images: You represent you have rights to any images or materials you upload.

6) Prohibited use

You agree not to:

• Use the Service for unlawful, harmful, or abusive purposes
• Attempt to gain unauthorized access to the Service or other users' data
• Interfere with or disrupt the Service
• Upload malicious code

7) Subscriptions, billing, and payments

• The Service may require a paid subscription to access certain features.
• Subscription pricing and renewal terms are shown at checkout.
• Payments and subscription management are handled by Polar (a third-party billing provider). Pop The Plan does not store your full payment card information.
• Auto-renewal: Subscriptions typically renew automatically until cancelled.
• Cancellation: You can cancel in your billing portal (when available) and your subscription will end at the conclusion of the current billing period.
• Refunds: Fees are non-refundable except where required by law, unless we explicitly state otherwise.

8) Intellectual property

The Service (excluding User Content) is owned by Pop The Plan and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service except as allowed by these Terms.

9) Third-party services

The Service may rely on third-party services (such as Google for authentication and Polar for billing). Your use of those services may be governed by their own terms and policies.

10) Disclaimer of warranties

The Service is provided "as is" and "as available". To the maximum extent permitted by law, Pop The Plan disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11) Limitation of liability

To the maximum extent permitted by law, Pop The Plan will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill.

To the maximum extent permitted by law, Pop The Plan's total liability arising out of or relating to the Service will not exceed the amounts you paid to Pop The Plan for the Service in the 12 months before the event giving rise to liability (or $100 if you have paid nothing), whichever is greater.

12) Indemnification

You agree to indemnify and hold Pop The Plan harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service or your User Content.

13) Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we need to protect the Service or other users.

14) Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date when we do.
